Stallion Service Contract- Shipped Cooled Semen

THIS AGREEMENT is made and entered into this day and month written below between a PRISM PAINTS AND QUARTER HORSES, BAGLEY, MINNESOTA ("Stud Manager") and ___________________________________________ ("Mare Owner")

The parties agree as follows:

1. Mare Owner agrees to breed the mare ("Mare")

2. The stallion service fee shall be $300. This breeding fee will be paid prior to semen being sent. A copy of both sides of the mare's registration papers must be included with this stallion service contract.

3. Additional charges will be made for the deposit on the shipping container ($250) and Federal Express or air freight shipping charges. The Equitainer/semen container deposit will be refunded to Mare Owner in full if Equitainer is returned to Stallion Owner within 72 hrs of breeding date (date semen sent to mare owner) or deposit fee forfeited. No semen shipments outside of North America.

4. Mare Owner shall attempt with reasonable diligence to settle Mare; if however, for any reason the mare does not settle, mare owner will hold stallion owner and manager harmless. The breeding season for shipped semen begins February 5th and closes June 1st at which time all shipments will be discontinued. If Mare does not settle after three breeding shipments, owner has the option of waiting for the next year or bringing the Mare to the farm. Semen is available on normal breeding days-Monday, Wednesday and Friday. A $150 collection fee will be charged each time the stallion is collected for your Mare and semen is shipped. Stallion owner must be notified 24 hrs prior to the date semen is to be shipped. There will be no collections/shipments on Sundays. All collection and semen fees must be paid prior to shipment.

Mare Owner is responsible for:(1)Notifying Stallion Owner a minimum of 24 hours prior to shipment date. (2)Determining mare's heat cycle and best insemination dates. (3)Using a Veterinarian or Breeding Technician to inseminate the mare within 48 hours of collection. (4)Notifying the Stallion Owner of the time and date of insemination. (5)Pregnancy checking the mare on or about 18-24 days and notifying Stallion Owner of the results. (6) Completing all required forms in a timely manner, including the collection/insemination certificate. (7) Paying all fees required by mare's breed for shipped semen registry, including DNA testing, parental verification, additional registration fees etc. (8)Inseminating only the designated mare with this stallion's semen.

Stallion Owner will: Ship Live and Viable semen to purchaser/mare owner in a timely manner. Complete all required forms in a timely manner.

5. Stallion Owner guarantees live foal from the breeding contracted herein. Live foal is defined as a foal that stands and nurses without assistance for 72 hours. Should the Mare prove not to be in foal in the year bred or lose her foal, or should the foal not stand and nurse without assistance, Mare Owner shall notify Stallion Owner in writing within one week of the foaling date ( or the date the Mare is proved not to be in foal or loses her foal); such notice shall be accompanied by a statement from a licensed veterinarian verifying that the foal is not "live" as defined above or has been lost as stated above. Under the foregoing circumstances and upon receipt of the specified notice, it is agreed;
a. Stallion owner shall give to Mare Owner a free season to the stallion the following year only and to the same Mare originally booked (unless otherwise mutually agreed in writing between Mare Owner and Stallion Owner). The Free season is only the stud fee. Deposit on Equitainer, shipping charges and subsequent additional collections charged as specified above.
b. If Mare Owner fails to deliver the Mare ( or a substitute Mare if mutually agreed as stated above) for rebreeding the following year, then any and all fees paid shall not be refundable; the right to rebreed is thereby canceled and Stallion Owner is released from any further obligation whatsoever.

6.This contract shall not be transferable by Mare Owner without the prior written consentof Stallion Owner. A breeders certificate will be issued when the Mare Owner notifies Prism Paints and Quarter Horses of the foal and only after payment of all bills due on the Mare has been received. This agreement constitutes the entire agreement between the parties; any amendment to or modifications of the terms of this agreement must be in writing.

7. Should it be necessary for Stallion Owner to employ an attorney to enforce any of the terms of this agreement, including collection of money owed, Mare Owner shall pay all reasonable attorney's fees, costs of suits, and other expenses reasonably related to enforcing this agreement.
